Cerpen: ENGEL V VITALEOleh AIDIL KHALIDMajalah I. Mei 2007(Ini merupakan versi asal sebelum sentuhan editor)Negara ini sudah lama makmur. Seingat saya sudah beratus tahun. Ya setelah tamatnya perang sipil tahun 1865. Tapi hari ini keharmonian yang telah sekian lama berdenyut dengan tenang itu tiba-tiba sahaja menjadi kencang denyutannya. Tercungap-cungap malah. Sesungguhnya hiruk-pikuk telah melanda!Manakan tidak kalau di luar sana dengan berlatarkan bangunan Capitol itu ramai sekali manusia yang berkumpul. Mereka semua sedang mendidih marah berarak penuh emosi menunjuk perasaan ke arah bangunan Mahkamah Agung yang megah berdiri dengan seni bina klasik Greek bersalutkan marmar Vermont seluruhnya itu. Panas mentari yang terpacak tegak di atas kepala setiap penunjuk perasaan menghangatkan lagi suasana pada tengah hari itu. Dengan suara lantang sekali-sekala terdengar mereka bertempik gempita sekali. “Hapuskan Earl Warren. Singkirkan hakim durjana itu!” Begitu juga dengan kain rentang-kain rentang yang dikibarkan oleh para penunjuk perasaan. Kelihatan jelas terbaca pada salah satu kain rentang tersebut. “Rakyat negara ini punya agama. Kami bukan komunis tak bertuhan!” Pada kain rentang yang lain pula tertulis. “Hapuskan rejim syaitan Earl Warren yang menidakkan agama!” Masing-masing kain rentang memaparkan mesej yang sama. Iaitu untuk menyingkirkan ketua hakim negara kami. Sesungguhnya pohon tidak akan tumbang andai tiada taufan yang melanda. Begitu juga rakyat tidak akan memberontak andai Ketua Hakim Earl Warren tidak membuat keputusan yang melanggar tatasusila sosial rakyat. Bayangkan saja rakyat mana yang tidak akan naik hangin andai upacara berdoa diharamkan sama sekali? Negara jenis apakah ini andai upacara keagamaan seperti itu diharamkan terus dari dipraktiskan di sekolah-sekolah awam?Sekolah-sekolah awam tempat terdidiknya anak bangsa kami yang menjadi tunggak harapan sebagai pemimpin di masa hadapan sudah diisytiharkan zon tanpa agama. Majlis-majlis keagamaan tidak boleh diadakan sama-sekali. Upacara membaca doa setiap sebelum kelas pun tidak boleh juga. Itulah keputusan yang dibacakan oleh ketua hakim negara kami. Earl Warren. Setahu saya hanya negara komunis sahaja yang tidak membenarkan sebarang hal keagamaan dari ditonjolkan. Kata mereka agama itu candu kepada masyarakat. Sekali terkena sukar terlepas. Oleh itu masyarakat perlu dijauhkan terus dari agama supaya mereka dapat hidup dengan aman. Itu negara komunis. Tapi negara kami bukan negara komunis. Rakyat di sini punya kepercayaan. Kalau tak percaya lihatlah pada helai-helai dollar dan syiling kami. Bukankah kata-kata “In God We believe” tercetak jelas? Begitu juga dengan upacara mengangkat sumpah sebagai presiden negara. Bukankah kitab suci digunakan? Jadi kenapa Ketua Hakim Earl Warren sampai hati membuat keputusan yang mengenepikan keagamaan sama sekali? Apakah dia seorang pendokong idealogi komunis? Saya benar-benar musykil. Setahu saya dari yang saya baca di akhbar-akhbar setiap hari negara kami sekarang sedang berperang saraf dengan negara-negara blok komunis. Kami berlumba dalam segala aspek. Dari segi kelengkapan ketenteraan kemajuan sains dan teknologi dan bermacam-macam lagi hal. Masing-masing ingin membuktikan kelebihan masing-masing. Malah baru-baru ini seisi rakyat negara kami gempar mendengarkan tentang perletakan peluru berpandu berbahaya di Cuba oleh negara Soviet tersebut. Nasib baiklah presiden negara kami. John F Kennedy berjaya menyelesaikan konflik tersebut secara aman dengan perdana menteri Nikita Krushchev. Manakan kami tidak risau apatah tempat peluru berpandu itu hanyalah kira-kira 90 batu sahaja dari provinsi Florida. Kalau meletup aduhai alamatnya pasti seisi Florida menjadi abu!Begitu juga halnya dengan penunjukkan dalam memberi sokongan. Negara kami secara terang-terangan memberikan bantuan kepada negara-negara yang ditekan oleh kedatangan ideologi komunis. Presiden negara kami baharu sahaja meluluskan penghantaran perwira-perwira negara kami ke Vietnam selatan bagi membantu mereka memerangi pengaruh komunis. Jadi apakah yang sebenarnya berlegar dalam kepala hotak Earl Warren saat dia memberikan keputusan mengharamkan upacara berdoa setiap sebelum memulakan kelas di sekolah-sekolah awam itu? Apakah dia juga telah terpengaruh dengan ideologi komunis yang tidak bertuhan? Ataukah pengaruh komunis sebenarnya sedang meresap masuk ke akar umbi negara kami dalam diam-diam tanpa kami rakyat-rakyatnya sedari?Begini ceritanya. Di New York sebuah sekolah telah memperkenalkan upacara pembacaan doa setiap kali sebelum bermulanya sesi kelas. “Upacara pembacaan doa ini,” kata pengetua sekolah tersebut. “adalah sebagai satu cara bagi pihak sekolah mendidik serta menyemai jati diri dan sahsiah moral yang terpuji terhadap para pelajar.”Namun demikian ternyata niat baik pihak sekolah ini tidak mendapat persetujuan segolongan ibu bapa. Menurut mereka memperkenalkan amalan pembacaan doa seperti itu melanggar prinsip kebebasan beragama. Mereka tidak mahu anak-anak yang telah mereka didik sedari kecil sebagai pemikir-pemikir bebas (remove thinker) disogokkan dengan amalan keagamaan seperti itu di sekolah-sekolah. “Sekolah,” menurut Encik Engel salah seorang dari ibu-bapa yang menentang. “tidak seharusnya menjadi tempat anak-anak kita disogokkan dengan fahaman-fahaman keagamaan. Lebih-lebih lagi di sekolah yang dibiayai oleh pihak kerajaan yang para pelajarnya terdiri dari pelbagai latar belakang kepercayaan dalam beragama.”Dan ternyata. Mahkamah Agung telah bersependapat dengan pihak ibu-bapa yang menentang keputusan sekolah tersebut dalam memperkenalkan upacara pembacaan doa kepada para pelajar. Keputusan Mahkamah Agung tersebut mempunyai implikasi yang sangat besar ke atas doktrin kebebasan beragama di negara kami. Mengharamkan upacara berdoa di sekolah-sekolah secara tidak langsung bermaksud selepas ini sebarang upacara keagamaan tidak boleh lagi dilakukan secara rasmi di tempat-tempat yang dibiayai oleh kerjaan. Sekolah universiti pejabat-pejabat kerajaan dan sebarang tempat-tempat awam. Ya ya saya tahu memanglah negara kami ini adalah sebuah negara sekular yang memisahkan agama dari kenegaraan. Rakyat negara kami telah serik dengan apa yang melanda nenek moyang kami beratus tahun yang lalu apabila tembok pemisah antara agama dan negara tidak tertegak. Akibatnya ramai sekali yang tertindas apabila gereja punya kuasa politik. Yang paling kasihan tentunya yang tidak punya kepercayaan yang sehaluan dengan kehendak gereja. Mereka dipaksa mempercayai dan kalau tidak alahai bercerailah kepala dengan badan. Bukan sedikit yang menjadi korban akibat menganut agama yang tidak direstui pihak gereja. Makanya sebab itulah di dalam perlembagaan negara kami yang diratifikasi kira-kira 200 tahun yang lalu telah termaktub dengan jelas doktrin pemisah antara agama dan negara. Bagi melindungi rakyat dari cengkaman kuku besi pihak gereja.“Tugas pihak kehakiman adalah untuk menterjemah undang-undang bertulis ke dalam bentuk praktikalnya sahaja.” Begitu kata Earl Warren sewaktu merumuskan pengadilannya. “Dalam hal ini,” katanya lagi. “kami para hakim hanya menterjemahkan klausa Pindaan Pertama yang termaktub dalam perlembagaan negara.” Itulah yang sering diulang-ulangnya di dalam media setiap kali menjawab cemuhan-cemuhan masyarakat ke atas keputusan kehakiman yang telah dibuatnya. Ya.
