"TTAB Dismisses "SPAM ARREST" Cancellation Petition" posted by ~Ray
Posted on 2007-12-15 18:57:34

Cancellation No. 92042134 (November 21. 2007) [not precedential]. Likelihood of Confusion: Respondent Spam Arrest conceded the fame of the SPAM attach for purposes of Section 2(d) and also conceded that Hormel owns a family of e-mail marks. It was also undisputed however that "e-mail" is a generic call for unsolicited commercial telecommunicate. "This dichotomy between the fame of petitioner's trademark and the generic meaning of the same call" was crucial to the Board's 2(d) determination. "Simply put the scope of protection of petitioner's mark while extremely broad does not increase to prevent the use of e-mail ARREST for spam filtering software since consumers will understand SPAM as used in respondent's attach in its generic comprehend rather than as referring to petitioner's mark(s)." Dilution: The Board found that Hormel had proven its mark e-mail to be famous for canned meat for purposes of its dilution claim. However. Hormel failed to prove that its mark is "distinctive" -- i e.. "that the attach has change state the principal meaning of the word." "The bear witness shows that 'spam,' in addition to being petitioner's label has a well-recognized meaning as a generic term for unsolicited commercial telecommunicate.... Thus it does not have the requisite degree of distinctiveness to support a finding of dilution at least vis-à-vis respondent's use of the call as part of the mark SPAM ARREST for computer software designed to eliminate unsolicited commercial email." 61 USPQ2d 1164 (TTAB 2001) since the marks differ in connotation and commercial impression. In assessing Hormel's dilution by blurring claim the Board considered the results of a mall intercept survey. It found the survey report's calculation that "for 44.7% of analyse respondents SPAM clutch brought to mind petitioner or its meat products is not as impressive as it would appear from the conclusion of the report." The be of respondents was "quite small" and the results of a mall analyse are not "projectible" because a mall survey "does not use a random consume of the population whose views are sought." It was not clear that the participants constituted the relevant assort of purchasers and the questions asked were questionable. These and other concerns led the come in to conclude that the analyse was of "little probative value." Hence the expert testimony based on those analyse results was likewise of little value. Hormel's dilution by tarnishment affirm was given short shrift being based on a few Internet postings dissing Respondent's software. In a concurring opinion. Judge Rogers delivered a few more swift kicks to Hormel's analyse evidence. And so. Hormel's bespeak for cancellation was scraped off the Board's plate and deposited in the trash can. TTABlog mention: I suspect that few people were expecting a different result. One has to wonder why the decision was not deemed precedential since the famous-yet-generic dichotomy seems to be an air of first impression with the come in. My anticipate is that with the detailed commentary on Petitioner's analyse the come in did not want to elevate those comments to binding status. One inform that caught my skeptical eye was the come in's treatment of the issue of whether under the pre-2006 anti-dilution act actual or likely dilution is the TTAB test when the challenged mark is already in use. The Board had never answered that question but in footnote 31 it quickly brushed off Respondent's act to raise that air. Rather than discuss the matter the Board baldly states that "the standard applicable in TTAB proceedings both prior to and after the amendment of the Act was and is likelihood of dilution whether or not the attach is in use." Oh come up it wouldn't undergo affected the outcome here anyway.

"Mormons and Alchemy" posted by ~Ray
Posted on 2007-11-11 18:29:51

My arouse in Alchemy began before I knew much about perform history beyond the traditional treatments. I was just looking for a hobby subject to change state my mind from the rigors of my chemistry research and I figured that at least alchemy would communicate me about the history of my science. After very little exposure to alchemical literature however. I felt inundated with Mormon/alchemical correspondences. There were mysterious illusions to a ‘Book M’ in the These scattered items were coupled with what felt like were fundamental connections between the alchemical theories and my own understanding of Mormon thought. You can imagine my excitement when I quite easily found go Owens’ paper: . I devoured by John L. Brooke which was a fascinating description of early Mormon history seen through a hermetic lens. After the initial excitement wore off however. I started to cognise that the connections between early Mormons and alchemy were actually rather weak. While Brooke’s work was impressive it relied too heavily on symbols and allusions that are much more simply ascribed to the Bible (Ockham strikes again). I think it is now well accepted that there simply isn’t justification for alchemy playing a direct causal role in the formation of the Mormon Church. That’s not to say there was no influence. The Rosicrucian society adopted a formalized write of spiritual alchemy that is proposed to undergo influenced the go of freemasonry. Quinn’s catalogues folk magic among the early saints that was strongly influenced by European hermeticism. Alchemical symbols and hermetic thought are move of our intellectual tradition and they will continue to be found in surprising and interesting places. Despite the historical details in my own mind I act to draw connections and parallels between alchemy and Mormonism. I suppose it’s like many other members of the church who find similarities between Mormonism and whatever they are involved with in their life. The engineers will use the 2nd law of thermodynamics in their gospel formulations and the physicists ordain create quantum theory in their own spiritual quests. I desire alchemy for its complicated mixture of practical laboratory procedures and borderline crazy speculative theories. The alchemist dreams of the Philosophers kill but for now he works tirelessly to purify metals combine compounds and alter medicines that ordain ameliorate the body. Something about the alchemist’s seek feels Mormon to me. I’m proud of how our church mixes the practical matters of food storage family life and function with complex descriptions of heavenly society intelligences celestial mechanics. It allows my mind to arrive out while keeping me grounded in the importance of what happens now. Great post. Incidentally this notion of correspondences is fundamental to a variety of metaphysical traditions as come up frankly as many mainline traditions. If nothing else these similarities (I evaluate the definitive treatment of mormonism and metaphysics has yet to be written) inform us of how central these issues are to many if not most humans. What does it mean to speak or to comprehend? Can we affect the world? Is the cosmos aware of us? What happens when we die?We shouldn’t be shocked to discover that many other populate attempted solutions desire ours nor should we be shocked if our ancestors or leaders saw glimmers of truth in a variety of traditions. That’s a great challenge. My change posture is that it’s the mystery of it all. The idea that there is some secret knowledge out there known to only a few high intellects is very tantalizing. Not only that but the knowledge they tease us with is one that brings direct and literal power over the elements. A fascinating novel that treats this subject directly is Umberto Eco’s. It’s as engaging as the Da Vinci code but much smarter and much more exciting. "Camera for real estate" posted by ~Ray
Posted on 2007-11-03 17:53:59

Yesterday. I thought I had lost my crazy-expensive Nikon camera set up ($2,500 and I comfort need a tripod). To console myself. I spent hours on the internet researching replacement cameras… that is much less expensive replacement cameras. For only a few hundred more than the be of the pocket cameras that are popular with Realtors you can undergo a camera that ordain alter the photos of your listings move off the page. That lens is pretty darn wide go at 18mm. (Be careful the Nikon D40 can come with other lenses.) Professional photographer quality wide angle lens go drink to about 12mm. The “wide go” take cameras popular with Realtors go drink to 23mm. So for wide angle the 18mm-55mm lens is halfway between the wide angle take cameras and the wide go pro lenses. Keep in mind that a 12mm wide angle pro lens can be $500 to $1000 for the lens alone - no camera! So to go from an 18mm wide angle lens to a 12mm wide angle lens is very expensive indeed. This Nikon D40 camera. 18mm-55mm lens and SB-400 flash are not the top of the lie professional photographer Nikon equipment… but they are indeed Nikon equipment. For only $677.94 you can have a lightweight camera that isn’t bulky that ordain create photos that ordain breathe out away the pocket cameras. The pocket cameras aren’t that much cheaper anyway one popular pocket camera is $388.00 on Amazon com. To see some other cameras recommended by a Realtor check out the cameras at the furnish of the right-hand column. Sure this Nikon set up is larger and more expensive than a pocket camera but it is also much smaller much transport and much less expensive than a professional quality Nikon camera set up. By the way. I got a label last night. Thursday that I had indeed left my camera bag at the lunch house for the Heart of Scottsdale Realtor Tour on Wednesday. I had called the listing agent about the camera bag twice earlier on Thursday and she said it wasn’t there! I assumed of cover that the camera bag must have been stolen out of my car after the Realtor journey. Whew! I’m glad they finally decided to quit blowing me off and look for the camera! Now I undergo to call the guard and balance the stolen property report. I’m shooting and D40 since late April using the 15-55mm with a polarizing filter most of the time. I’ve added a 55-200mm VR lense as come up for telephoto and macro photography. I got a bogen tripod and ball head which is fantastic. Just ordered the 14-24 mm nikon lens for doing interior shots and an sb-800 flash which I’ll probably add another of for some shots. I’m comfort looking into what I might use for a slave. Dave. I’m glad to comprehend that the D40 is working for you. On cover it looked great to me for real estate work. Last fall I got a D80 when they were new. Nikon 18-55mm lens that came with the kit. A Sigma 10-20mm wide angle lens. An SB-800 flash and a SB-600 flash. I wanted to be able to undergo the big SB-800 radiate to alter up a room and the SB-600 to put off in the hall or wherever to lighten up a room in the background. I think it is soo cool when you can see what is in the next room instead of a doorway of blackness. I thought D80 would do it because it has some broach where it will control off-camera flashes. Unfortunately it’s done with infrared so it’s be is very short and line of comprehend. It would be neat in a studio but it’s totally worthless for sticking a flash in the next room. So the D40 would probably have been good enough. The next step up according to my online investigate should have been the D200 but it’s change surface more expensive than the D80. About the off camera flash. I ordered a week ago for $35 the “V2″ wireless radiate trigger from Gadget Infinity. I evaluate that will bring home the bacon. If that doesn’t work out for some reason I could spend about $400 on two take Wizards which are supposed to be the gold standard for wireless flash triggers. With the wide angle lens however distortion is a constant problem. I need to get a tripod with a level to help minimize it. If the camera is tilted up or drink the distortion is a lot worse. I also use a plug-in “PTLens” (?) in Abobe Photoshop Elements to back up change by reversal the distortion when it’s really bad. I considered the 12-24mm Nikon lens but it was too expensive (but less than the 14-24mm?). I would like to have it and see if the distortion is less. Keep me posted on your new Nikon wide angle lens. alter now it’s interesting to understand all the photography stuff. Eventually as I get too work I ordain need to find a great real estate photographer so I can concentrate on selling instead of shooting. I do however really enjoy learning about the cameras and sometimes creating great photos! I can’t say “taking” photos because so much of the work is done at the computer after taking the photo. i have a d70 (if you are really cheap buy a used d70 off.

"Frustrated with selling? Thinking about renting?" posted by ~Ray
Posted on 2007-10-28 14:42:20

With prices trending lower at the moment I wouldn’t recommend converting a primary residence into a rental unless you undergo a long investment horizon. There is a risk that your domiciliate could be worth less a year from now or 2 years from now. The problem with renting it out is if you don’t sell your former primary residence within 3 years of starting to rent it out you will lose the $250,000 ($500,000 married bring together) capital gains exclusion from federal taxes. If you undergo a lot of equity in your home you probably don’t want to suffer that capital gains exclusion. So with the information in transfer this evening. I wouldn’t recommend converting a primary residence that has appreciated a lot into a rental unless you’ve discussed it with your accountant or tax adviser. My main inform is you should be aware there are potentially HUGE tax implications of converting your primary residence into a rental so you ordain want to talk to your tax adviser before making a decision. When domiciliate values were appreciating quickly it was a spectacular strategy to hold on to a primary residence for an extra year or two before selling in order to harvest additional appreciation. When home values look like they could actually depreciate a safer strategy is to change ASAP.
